Terms of Service

Effective date: 1 March 2025

1. Agreement

By creating an account or using Tapa, you agree to these Terms of Service and our Privacy Policy. If you are using Tapa on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

Tapa is operated by Berican Labs Ltd, incorporated in Kenya. These terms are governed by the laws of Kenya.

2. The service

Tapa provides digital business cards delivered via NFC-enabled physical cards and QR codes. Your card has a public profile URL (e.g. tapa.co.ke/yourslug) that displays your contact information when tapped or scanned.

We also offer an analytics dashboard (scan counts, referrer type, approximate country) and, for Enterprise subscribers, team management features.

3. Accounts

  • You must be at least 16 years old to create an account.
  • You are responsible for all activity under your account.
  • Keep your magic-link emails confidential and do not share access.
  • You may only create one personal account. Duplicate accounts may be removed.
  • Your card slug is unique and chosen on a first-come, first-served basis. We may reclaim slugs that are inactive for more than 12 months after subscription expiry.

4. Subscriptions and payment

  • Tapa subscriptions are billed annually. The current price for the Starter plan is KES 1,000 per year, which includes your physical NFC card and shipping.
  • Enterprise pricing is agreed separately — contact us for a quote.
  • Subscriptions do not auto-renew unless you enable that option.
  • We do not offer refunds on physical cards once shipped.
  • If your subscription lapses, your public profile remains accessible for 30 days after expiry, after which it is deactivated (not deleted).

5. Your content

You own the content you add to your Tapa profile. By adding content, you grant us a non-exclusive, royalty-free licence to display it on your public profile and store it to provide the service.

You must not publish content that:

  • Is false, misleading, or impersonates another person or organisation
  • Violates any applicable law or regulation
  • Contains spam, malware links, or phishing material
  • Infringes third-party intellectual property rights
  • Is obscene, defamatory, or harassing

We may remove content that violates these rules and may suspend or terminate accounts that repeatedly or seriously breach them.

6. Enterprise accounts

Enterprise subscribers can create an organisation, invite team members, and access aggregate analytics for all cards in the organisation. The organisation admin is responsible for the conduct of all members added to the organisation.

Seat limits apply per subscription tier. Adding members beyond the purchased seat count is not permitted without upgrading.

7. Acceptable use

You agree not to:

  • Attempt to reverse-engineer, scrape, or extract data from the platform at scale
  • Use automated tools to create accounts or generate scans artificially
  • Interfere with the security or integrity of the platform
  • Use the service to send unsolicited communications to others

8. Intellectual property

The Tapa name, logo, and platform design are the property of Berican Labs Ltd. Nothing in these terms grants you any right to use our brand assets without prior written consent.

9. Disclaimer of warranties

Tapa is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability. Physical cards are subject to shipping timelines that are outside our direct control.

10. Limitation of liability

To the extent permitted by Kenyan law, Berican Labs Ltd's total liability to you for any claim arising from these terms or the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential losses.

11. Termination

You may close your account at any time by contacting us at [email protected]. We may suspend or terminate your account if you breach these terms, with or without notice depending on severity.

On termination, your public profile is deactivated. Personal data is purged within 30 days in accordance with our Privacy Policy.

12. Changes to these terms

We may update these terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.

13. Governing law and disputes

These terms are governed by the laws of Kenya. Any dispute that cannot be resolved informally will be referred to the courts of Kenya.
